Terms of Service for Futurely

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Futurely ("Company," "we," "us," or "our") regarding your use of the Futurely mobile application ("App"). By creating an account, accessing, or using the App, you agree to comply with and be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• All information you provide is accurate and truthful
• You will comply with all applicable laws and regulations

3. Account Registration

• Apple Sign-In: You must sign in using Apple Sign-In to create an account
• Account Security: You are responsible for maintaining the confidentiality of your account
• Account Information: You agree to provide accurate and complete information during registration
• Prohibited Accounts: You may not create multiple accounts or share your account with others

4. Subscription and Payment

4.1 Subscription Plan

• Price: $14.99 per month
• Billing: Charged immediately upon subscription - no free trial
• Auto-Renewal: Subscription automatically renews monthly unless canceled
• Payment Processing: All payments are processed through Apple's In-App Purchase system

4.2 Subscription Terms

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings

4.3 Refunds and Cancellation

• Cancellation: You may cancel your subscription at any time through your Apple ID Account Settings
• Effect of Cancellation: You will retain access until the end of your current billing period
• No Partial Refunds: No refunds for partial months or unused time
• Apple Refund Policy: Refund requests are subject to Apple's refund policy
• Contact Apple: For refund requests, contact Apple Support directly

4.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal. You will be notified of price changes in advance.

5. License and Restrictions

5.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on a device you own or control
• Access and use the App for personal, non-commercial purposes

5.2 Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract source code
• Remove, alter, or obscure any proprietary notices
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App or servers
• Upload viruses, malware, or malicious code
• Attempt to gain unauthorized access to the App or related systems
• Use the App to harass, abuse, or harm others
• Impersonate any person or entity
• Use automated systems (bots, scrapers, etc.) to access the App

6. AI-Generated Content and Images

6.1 AI Image Generation

• Purpose: Images are generated using AI to help visualize your goals and aspirations
• No Guarantees: AI-generated images do not predict, guarantee, or ensure future outcomes
• Personal Use: Images are for your personal, non-commercial use only
• Third-Party AI: We use third-party AI services (OpenAI, Google) to generate images

6.2 Content Ownership

• Your Photos: You retain all rights to photos you upload
• Generated Images: You receive a personal, non-exclusive license to use AI-generated images created for you
• Our Rights: We retain all rights to the App, technology, and infrastructure
• Limited License: You may download, save, and share generated images for personal use
• Prohibited Use: You may not sell, license, or commercially exploit generated images

6.3 Content Guidelines

You agree that your uploaded content (photos, preferences) will not:

• Contain nudity, sexually explicit, or pornographic material
• Depict violence, hate speech, or discriminatory content
• Violate any third-party rights (copyright, trademark, privacy, publicity)
• Contain minors' photos without proper authorization
• Violate any applicable laws or regulations

We reserve the right to remove content and terminate accounts that violate these guidelines.

7. User Content and Privacy

• Your Responsibility: You are solely responsible for content you upload
• License to Us: You grant us a license to process your photos for AI image generation
• Privacy: Your use of personal photos is governed by our Privacy Policy
• No Review: We do not pre-screen user content but reserve the right to review and remove content

8. Intellectual Property Rights

• Our Property: The App, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws
• Trademarks: "Futurely" and related logos are our trademarks - you may not use them without permission
• Feedback: Any feedback you provide may be used by us without compensation or attribution

9. Disclaimers and Limitations

9.1 No Medical or Professional Advice

9.2 No Guarantees of Results

We make no guarantees, representations, or warranties that:

• Use of the App will achieve specific results or outcomes
• AI-generated images will accurately predict or manifest future events
• The manifestation techniques will work for you
• Your goals or aspirations will be achieved

9.3 "AS IS" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding accuracy, reliability, or quality of content

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage
• Reliance on AI-generated content or manifestation techniques
• Interruptions or errors in the App

MAXIMUM LIABILITY: Our total liability to you for any claims arising from these Terms or the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is less.

11. Indemnification

You agree to indemnify, defend, and hold harmless Futurely, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the App

12. Termination

• By You: You may delete your account at any time through App settings
• By Us: We may suspend or terminate your account if you violate these Terms
• Effect: Upon termination, your right to use the App immediately ceases
• Survival: Sections that by their nature should survive termination will continue to apply

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending a push notification (for significant changes)

Your continued use after changes constitutes acceptance of the updated Terms.

14. Modifications to the App

We reserve the right to:

• Modify, suspend, or discontinue any part of the App at any time
• Change features, functionality, or content
• Impose limits on certain features

We are not liable for any modification, suspension, or discontinuation of the App.

15. Third-Party Services

• Apple Services: Use of Apple Sign-In and In-App Purchases is subject to Apple's Terms of Service
• AI Services: OpenAI and Google AI services are subject to their respective terms
• Not Responsible: We are not responsible for third-party services or their terms

16. Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of California, USA, without regard to conflict of law principles
• Venue: Any disputes shall be resolved in the state or federal courts located in California
• Arbitration: You agree to resolve disputes through binding arbitration, except for small claims court or intellectual property claims
• Class Action Waiver: You agree to bring claims individually, not as part of a class action

17. Apple-Specific Terms

If you access the App via an Apple device, you acknowledge and agree that:

• These Terms are between you and Futurely, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims relating to the App
• In the event of any failure to conform to warranties, you may notify Apple for a refund, and Apple will have no other warranty obligation
• Apple is not responsible for any claims related to the App, including product liability, legal compliance, or intellectual property infringement
• You comply with all applicable third-party terms when using the App (e.g., wireless data agreement)
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms

18. Miscellaneous

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms; we may assign them without restriction
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our control
